New on Paternalism and Public Policy

چکیده
Bill New's (1999) thoughtful paper has performed the valuable service of clarifying the meaning and the policy implications of paternalism. His careful formulation delimits the domain of justified state paternalism. Having argued successfully, in our view, for a narrow ambit, New proceeds to identify situations that justify paternalism. This comment is written in the spirit of a friendly reformulation that refines and improves the specification of when paternalism is justified. Our argument is twofold. First, we argue that New's formulation, properly understood, will not readily permit the paternalistic interventions he argues are justified. Second, we identify a class of potentially justified interventions that have paternalistic aspects, but which are neither strictly paternalistic nor market-failure remedies. New defines paternalism as the non-consensual interference in the self-regarding decision making of an autonomous person, which is intended to further the person's welfare, where autonomous persons are adults not incompetent, incapacitated, nor under coercion (1999, p. 65). New's definition excludes as non-paternalistic the following kinds of policies:

Why It’s Time to Stop Worrying About Paternalism in Public Health Policy
Public health policies which involve active intervention to improve the health of the population are often criticised as paternalistic. This paper argues that it is a mistake to frame our discussions of public health policies in terms of paternalism. First, it is deeply problematic to pick out which policies should count as paternalistic; at best we can talk about paternalistic justifications f...

This chapter concerns the normativity of the concepts of paternalism and libertarian paternalism. The first concept is central to evaluation of public health policy, but its meaning is controversial. The second concept is equally controversial and has received much attention recently. It may or may not shape the future evaluation of public health policy. In order to facilitate honest and fruitf...
متن کاملTax policy and present-biased preferences: Paternalism under international capital mobility ¬リニ
This paper deals with tax-policy responses to quasi-hyperbolic discounting. Earlier research on optimal paternalism typically abstracts from capital mobility. If capital is mobile between countries, it may no longer be possible for national governments to control domestic savings via capital taxation (as in a closed economy). In this paper, we take a broad perspective on public policy responses...
متن کاملChoosing Health and the inner citadel.
It is argued in this paper that the latest UK government white paper on public health, Choosing Health, is vulnerable to a charge of paternalism. For some years libertarians have levelled this charge at public health policies. The white paper tries to avoid it by constant reference to informed choice and choice related terms. The implication is that the government aims only to inform the public...
